These Terms of Service (“Terms”) govern your access to and use of the website located at hookedoncouragecourse.com (the “Site”), as well as any educational curricula, digital products, workshops, and services provided by Hooked on the Wizard LLC, doing business as Hooked On Courage (“we,” “us,” or “our”).
By accessing the Site or purchasing our products, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or purchase our products.
1. Eligibility and Account Registration
1.1 Age Requirements
The Site and our products are intended for purchase by adults (parents, legal guardians, educators, and school administrators) who are at least 18 years of age. While our educational programs are designed for children (Kindergarten through 12th grade), children under the age of 18 may only use our digital programs under the direct supervision of a parent, legal guardian, or authorized educator.
1.2 Account Creation
To access certain features or purchase curricula, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate. You are responsible for safeguarding your password and for all activities that occur under your account.
2. Intellectual Property and Licensing
2.1 Ownership
All content on the Site, including but not limited to text, graphics, logos, images, audio clips, digital downloads, curriculum materials, lesson plans, and software, is the property of Hooked on the Wizard LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.
2.2 Limited License for Personal/Classroom Use
When you purchase a curriculum bundle (e.g., Kindergarten, Grade 1-8, or Complete K-12 Bundle), we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the materials for your personal, non-commercial use, or for use within your specific, individual classroom.
You may not:
• Reproduce, duplicate, copy, sell, resell, or otherwise exploit the materials for any commercial purpose.
• Share your account access or digital downloads with other teachers, schools, or individuals who have not purchased a license.
• Modify, alter, or create derivative works based on our curriculum without our express written consent.2.3 School and District Licensing
If you are purchasing on behalf of a school, school district, or organization, the standard individual license does not apply. You must contact us directly to negotiate a bulk licensing agreement or vendor contract that outlines the scope of permitted use across multiple classrooms or campuses.
3. Purchases, Pricing, and Refunds
3.1 Pricing and Availability
All prices for our products are listed in U.S. Dollars and are subject to change without notice. We reserve the right to modify or discontinue any product or service at any time.
3.2 Payment Processing
Payments are processed securely through third-party payment gateways (such as WooCommerce, SureCart, PayPal, or Stripe). By submitting payment information, you authorize us and our third-party processors to charge the applicable fees to your designated payment method.
3.3 Refund Policy
Due to the digital nature of our educational curricula and downloadable products, all sales are final and non-refundable once the digital content has been accessed or downloaded. 4. Disclaimers and Limitation of Liability
4.1 Educational Outcomes Disclaimer
Hooked On Courage provides arts-integrated educational programs designed to foster creativity, confidence, and emotional intelligence. However, we make no guarantees, representations, or warranties regarding specific academic, psychological, or behavioral outcomes for any individual student. Our programs are educational in nature and are not a substitute for professional psychological counseling, therapy, or medical treatment.
4.2 “As Is” Basis
The Site and all products and services delivered to you through the Site are provided “as is” and “as available” for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
4.3 Limitation of Liability
To the fullest extent permitted by law, in no event will Hooked on the Wizard LLC, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
• Your access to or use of or inability to access or use the Site or products;
• Any conduct or content of any third party on the Site;
• Any unauthorized access, use, or alteration of your transmissions or content.In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount you paid to us for the specific product or service giving rise to the claim.
5. In-Person Workshops and Events
If you or your child participate in any in-person workshops, community engagement projects, or physical events hosted by Hooked On Courage:
• You acknowledge that participation involves certain inherent risks. • You may be required to sign a separate Liability Waiver and Assumption of Risk form prior to participation. • Hooked on the Wizard LLC is not liable for any physical injury, property damage, or other loss sustained during these events, except in cases of gross negligence or willful misconduct.
6. User Conduct
You agree not to use the Site to:
• Violate any local, state, national, or international law or regulation.
• Transmit any material that is abusive, harassing, tortious, defamatory, vulgar, pornographic, obscene, libelous, or otherwise objectionable.
• Transmit any malicious code, viruses, or harmful software.
• Attempt to gain unauthorized access to our servers, networks, or user accounts.We reserve the right to terminate your account and access to the Site if you violate these rules of conduct.
7. Indemnification
You agree to defend, indemnify, and hold harmless Hooked on the Wizard LLC, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site or our products.
8. Governing Law and Dispute Resolution
These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions.
Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in Delaware County, Pennsylvania, using the English language in accordance with the Arbitration Rules and Procedures of the American Arbitration Association.
9. Changes to Terms of Service
We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our Site. It is your responsibility to check our Site periodically for changes. Your continued use of or access to our Site or the Service following the posting of any changes to these Terms constitutes acceptance of those changes.
